The seller needs to provide the following documents to the buyer before conditions can be waived:
- Copy of bylaws of the corporation
- Copy of the most recent financial statements of the corporation
- Copy of the budget of the corporation
- Statement setting out amount of monthly contributions and basis on which that amount is determined
- Copy of minutes of a general meeting of the corporation/board for past 12mths
- Copy of the insurance certificate
- Copy of any lease/exclusive use agreement with respect to the possession of a portion of common property, including parking stall or storage unit
- Particulars of, or copy of, any subsisting management agreement
- Particulars of, or copy of, any subsisting recreational agreement
- Statement setting out structural deficiencies of which the corporation is aware
- Statement setting out the amount of the capital replacement reserve fund
- Copy of the most recent reserve fund report
- Copy of the most recent reserve fund plan
- Particulars of any post tensioned cables located anywhere on/within the
- Statement setting out amount of any contributions due and payable in respect
- Particulars of any action commenced against and served on the corporation
- Particulars of any unsatisfied judgment or order for which the corporation is liable
- Particulars of any written demand made on the corporation for an excess amount
